You can't go home again

It seems that John Lee Nuebel, recently of Tucson, Arizona, wanted to move back into the house in which he once lived on Wilt Road near Sisters.

There was a problem: Nuebel doesn't own the house and someone else has been living there for a year.

Nuebel, 39 was arrested by Deschutes County Sheriff's deputies Tuesday April 9 on charges of burglary, criminal mischief, theft and trespass after he allegedly twice broke into the Wilt Road house and, according to police reports, made himself at home.

According to police reports, the incident began on the night of Monday, April 8, when the man who currently rents the house on Wilt Road returned home to find Nuebel in the house in his underwear. When the renter asked him what he was doing in the house, Nuebel allegedly replied "I live here and you have to move."

The renter contacted police and asked them to get Nuebel to leave, but, police reported, the renter didn't want to press charges because he was not sure who owned the house after listening to Nuebel's conversation. He allegedly told Nuebel to leave and not return unless he had papers to prove his ownership.

The renter told police that the house was "in shambles" and Nuebel appeared to have slept in the renter's bed. Nuebel allegedly entered the house by jimmying the front door lock.

Nuebel allegedly returned the next day but left after the renter spoke to him in the driveway of the house.

The following day, the renter's girlfriend stopped by the Wilt Road house to check on things and allegedly found Nuebel in the house again, sitting in a chair watching television, drinking a beer and smoking a cigarette.

The woman told police that she asked Nuebel what he was doing there and he replied that he lived at the house. The woman allegedly told Nuebel to leave and called police. Nuebel was outside the residence when a Deschutes County deputy arrived.

According to police, Nuebel told them he had entered the house this time through a bedroom window. He claimed to have the renter's permission and said that since the house was his, he prepared himself something to eat and was watching TV.

Police reported that Nuebel was wearing a shirt, boots and ball cap that came from the house. Nuebel said they were his; the woman told police they belonged to the renter.

According to police, the renter decided to press charges against Nuebel and a deputy arrested Nuebel.

When the deputy checked Nuebel's driving status, he allegedly found an expired driver's license with the Wilt Road address. Nuebel allegedly told police that he had lived in the house two years ago and sold it to a West Linn couple when he and his wife moved to Arizona. He then allegedly said he didn't sell it but was letting the couple use it.

Police determined that Nuebel and his wife had in fact sold the house in December of 1993. According to police reports, the renter has been leasing the house through a Sisters property management office for about a year.

Nuebel allegedly had several prescription medicines in his name when he was taken to jail.

The renter reported that some cash was missing as well as a quantity of food. Nuebel was lodged in county jail on charges of first degree burglary, Theft II, Criminal Mischief III and Criminal Trespass II.

Bail was posted for Nuebel April 11; he is to return to court April 26.
