Testimony before Judge Steven Tiktin and a jury of 12 was expected to continue Tuesday in the case of A. Wayne and Marlene Scott, owners of the RV park, versus Barclay Contractors, the primary contractors on the 1994 project.
The Scotts are suing Barclay for approximately $170,000, claiming the contracting company improperly installed concrete RV pads and sewer lines, and killed 17 trees by exposing their roots during excavation.
The Scotts also sued general contractor David Clemens for failing to adequately oversee the project, and were themselves sued by Sun Country Engineering, Inc., for failing to pay for engineering services.
Clemens and Barclay Contractors, both of whom dispute the allegations, refused comment until the case is settled.
According to court records, Clemens filed a counter-claim for $10,000 alleging he was not paid on his original $40,000 contract with the Scotts.
Clemens reached a settlement with the Scotts that is tied to the outcome of the Barclay trial.
The insurance company for Sun Country Engineering also decided to settle with the Scotts, paying both sides, the Scotts and Sun Country, undisclosed sums, according to other litigants who did not want to be identified.
According to the case register, the lawsuit was dismissed in October 1995, but a member of the law office of Stanley Austin, Sun Country's attorney, indicated that the settlement was also tied to the outcome of the Barclay case.
