Aspen Lakes Develop-ment, L.L.C., filed a lawsuit against Milroy Golf Systems on June 26, 1997, for $130,000, alleging that Milroy failed to complete installation "as per the terms and conditions of the agreement or in failing to complete said work in a workmanlike" manner.
A story published last week in The Nugget referred to only a companion lawsuit by Milroy against Aspen Lakes, alleging that the devloper owed $42,299.25 for work done.
According to documents sent to The Nugget by Matt Cyrus, partner in the Aspen Lakes development with his father Keith and sister Pam, there is a variety of problems with the irrigation line installation on each hole of the golf course and the driving range.
These problems include sunken valve boxes in the fairways, sprinkler heads not set to grade, broken lines, leaking joints, improperly wired controllers, and shallow lines and wiring.
Keith Cyrus had told The Nugget that Milroy Golf Systems owner John Milroy "had sent his boy over to do the work. Every day we find a few things wrong."
J.T. Milroy, who headed up the crew which installed the irrigation system, would not comment on advice of their attorney. Matt Cyrus was also circumspect, referring only to the filed documents.
In last week's Nugget, only the lawsuit against Aspen Lakes filed on May 13, 1997, by Milroy Golf Systems, was described. The Nugget was not informed of the second lawsuit by Aspen Lakes against Milroy by either party until Friday, August 8.
Milroy lawyer Thomas Murphy said that he had not seen the lawsuit until it was faxed to him by Aspen Lakes attorney Roger Anunson on Wednesday, August 6, the day The Nugget article was published.
Murphy said neither Milroy Golf Systems nor its owner John Milroy had yet been served a copy of the Aspen Lakes lawsuit.
According to Aspen Lakes lawyer Anunson, "we hope to settle this thing. In order to expedite the process, today (Friday, August 8) we will be filing a motion to consolidate the cases."
He said Milroy would be served this week.
