News and Opinion from Sisters, Oregon
Nicholas Levine has been sentenced to 120 days in jail and 36 months probation for dealing drugs in Sisters.
Levine was arrested last September with Jeffrey Trainor and a female juvenile for delivering marijuana in Creekside City Park.
Trainor pleaded no contest, has served his time and been released on probation.
Levine pleaded guilty.
His sentencing hearing was held on April 12.
In delivering the sentence, Circuit Court Judge Alta Brady found that Levine would benefit from a treatment program and that probation would serve community interests by promoting reformation, according to the court minutes.
District Attorney Michael Dugan would have preferred that Levine spend more time in jail.
As far as drug dealers are concerned, it has been a long standing position of the DA's office that the issue is drug profits, not recovery. We keep asking the courts to consider the impact of their decisions on the local community, Dugan said.
According to the court minutes, Levine must participate in the "Your Choice program for drug offenders in the jail. Levine is also to refrain from using drugs without a prescription. He must not socialize with people who use illicit drugs or frequent places where such drugs are used. He must not drink alcohol or frequent places where alcohol is served unless he is there for work-related business.
Levine must also submit to random searches and urinalyses, have no contact with Jeffrey Trainor or the informants who participated in his arrest, and he must publish a letter of apology to the community.
